LIMITED PARTS & LABOR WARRANTY

I. The remanufacturer warrants to the installation facility that it will replace, repair or refund, at the remanufacturers' sole option, any long block engine for gasoline, on road applications, supplied by the remanufacturer, which is defective in material or workmanship, for three years (36 months) or 100,000 miles, whichever occurs first. This warranty is limited to the original installer. This warranty covers vehicle engines installed in passenger vehicles (includes vans, cars and pickup trucks up to ¾ ton). This warranty is limited to defects in workmanship and materials furnished by the remanufacturer and is not an unconditional guarantee against all hazards or failures (see exclusions and limitations to Limited Warranty). All repairs must have prior factory authorization. Any representations or warranty offered the vehicle owner are the responsibility of the facility selling or installing the engine. Is the responsibility of the installation facility to inform the vehicle owner of all provisions required to maintain this warranty to the installer.

If it is determined by the remanufacturer that an engine or engine part furnished by the remanufacturer is defective in workmanship or material, the factory will allow a labor adjustment according to the most recent All Data OEM Warranty Rate up to $40.00/hour, with a maximum labor payout of $450 per engine purchased. Do-it-yourself or repairs made by an unlicensed facility will be paid at a rate not to exceed $10.00 per flat rate hour. Labor allowances shall be paid only upon a determination that an engine or part supplied by the remanufacturer is defective in material or workmanship. The limited warranty period commences on the date of installation of the engine, which is the date on which the remanufactured engine is first installed in the vehicle. A warranty card, enclosed with the engine, must be filled out with installation date and vehicle mileage to validate warranty. The warranty registration card MUST be returned within 30 days of installation or the warranty will be voided.

This limited warranty is the sole and exclusive express or implied warranty made by the remanufacturer with respect to the remanufacturer's engines and parts, and is given in lieu of any other warranty. To the extent allowed by law, any and all express or implied warranties not set forth herein are waived and disclaimed, including any implied warranty of merchantability or fitness for a particular use. Liabilities under this warranty are limited solely and exclusively to repair or replacement of engines or parts according to the terms of this warranty only. Some states do not allow limitations on implied warranties or the exclusion or limitation of consequential or incidental damages; therefore, some of the exclusions and limitations may not apply to you. This limited warranty gives you specific legal rights and you may also have other rights, such rights may vary from state to state.

In the event that any provision of this warranty should be or become invalid or unenforceable because of any laws, the remaining terms and conditions hereof shall remain in full force and effect.

II. EXCLUSIONS AND LIMITATIONS

A. Commercial, business use, Class B&C motor homes, or vehicles of one ton or larger is limited to 12 month/36,000 mile parts & labor warranty on gasoline applications.

B. Class A motor homes are covered 30 days parts only on gasoline applications. Diesels used in class A motor homes are covered under the normal diesel warranty, however there is a $450 cap on the labor allowance.

C. Diesel Drop-In engines are warranted for 2 years unlimited mileage. Diesel short and long blocks are warranted for 1 year unlimited mileage. (1 year warranty for 6.5L Drop-In.) Diesel fuel injection systems are warranted for 12 months from the date of installation. Off Road diesels are warranted for 12 months or 2,000 hours whichever occurs first.

D. This Limited Warranty does not warrant against and does not cover damage or loss due to, but not limited to the following:

1. Misuse, maintenance neglect, abuse, vandalism, abnormal operation or accidents;
2. Defective or improper installation;
3. Improper break-ins or over speeding;
4. Environmental conditions, freeze cracks or overheating, if heat tab is melted, no warranty until factory determination;
5. Burned, scored, or melted pistons;
6. Lack of lubricants or fluids, if sludge is evident, no credit until factory determination;
7. Foreign material in combustion chamber or oil pan;
8. Failures of components or parts not furnished by the remanufacturer or otherwise approved by remanufacturer for installation, or components or parts unsuitable for use with a warranted engine or part such as, but not limited to performance parts;
9. Abnormal wear or tear or use of an engine or part for purposes other than for which it was originally intended or a change from original application.
10. Damage to pistons or other engine components from detonation or pre-ignition;
11. Crankshaft thrust surface worn due to defective or improperly installed clutch, or torque converter or motor mounts;
12. Internal modification with aftermarket performance parts;
13. Applications using propane, or l.p.g. are excluded under this warranty; Over fueling or other dilution of lube oil.

E. This Limited Warranty does not cover or provide payment or reimbursement for the following consequential damages:

1. Replacement oil, antifreeze, fluids or other substances used in normal maintenance;
2. Towing charges, vehicle rental or other substitute transportation;
3. Diagnostic time, labor (except as set forth above) or service calls;
4. Gaskets, or other parts or items associated with, but not included with warranted engine and/or parts;
5. Transportation charges, lodging and meals;
6. Loss of time, income, sales or profits;
7. Loss of use of vehicle;
8. Telephone calls or communication expense;
9. Lift, dock or storage fees;
10. Tune-ups or replacement of belts, hoses or maintenance items;
11. Routine, regularly required maintenance;
12. Injury or death to persons or damage or destruction of property;
13. Consequential or incidental damages.

F. Off road, industrial or stationary power units are warranted for 30 days, parts only.

III. CONDITIONS TO COVERAGE

This Limited Warranty is subject to the conditions set forth below. Failure to comply with these conditions will void this Limited Warranty.

A. All representations made in this Limited Warranty are made only to the installation facility. Any representations or warranty provided the vehicle owner are solely the responsibility of the facility selling the unit to the vehicle owner.

B. The vehicle owner must change the vehicle lubrication oil and filter at a minimum of every 5000 miles (3000 miles recommended) after the break in period. The vehicle owner must maintain records of proper oil change intervals and supply said records if requested by PROFormance Warranty Department.

C. The vehicle owner must follow the claims procedure when making a claim or this warranty will be void. Contact the engine installer or call (888) 381-8324 for questions on this procedure.

D. An engine or part that is furnished as a replacement under this Limited Warranty for an engine or part found to be defective is warranted only for the remainder of the warranty period remaining on the original defective engine or part.

E. No benefits, payments, repairs, replacements or remedies are available under this Limited Warranty while any invoice for an engine or part remains outstanding.

F. Claims for missing parts must be made at the time of initial delivery of the engine to the installer.

G. Timing belt is covered for 12 months from the date of installation, if installed at the factory.
